Training Policy and Liability WaiverThis is an agreement between High Octane Agility, LLC (hereinafter called “High Octane Agility” or “HOA”) and the pet owner/handler (hereinafter called “Owner”).

Training Policy

Proof of Vaccination: Owner affirms and has proof that the dog is current on all vaccinations (i.e. Rabies, DHLPP, etc.) appropriate for the dog. Owner agrees to provide proof of vaccination(s) upon request by HOA management.

Leashes: All dogs must be leashed and under control when entering and exiting the HOA facility including the arena, parking lot and adjacent walking areas. A flat, buckle collar and 4-6ft leash is required during class time. No prong, e-collar, or choke collars permitted anywhere on High Octane training premises.

General Health: Physical Condition: Participation in agility training requires physical activity such as running among obstacles on the part of the owner and running, jumping and the use of obstacles on the part of the dog. Both owner and dog should be in good health to perform the physical activities required.

Communicable Illness: Dogs that have been ill (or in a household with any dog(s) that has been ill) with any communicable condition (such as kennel cough, Giardia, Canine Papilloma Virus) will not be allowed to attend training until the dog is symptom free for a minimum of 10 days or written veterinary clearance is provided. Any health concerns, i.e. coughing, diarrhea, rash, etc., should be brought to the attention of HOA.  Refunding of fees paid for classes missed due to communicable illness will be reviewed on a case by case basis.

Nails: Dogs participating in agility training need to have their nails maintained at a reasonable length to ensure they do not slip when climbing agility obstacles.

Aggression: Owner represents that the dog is not a hazard to persons or other dogs. Any dog that exhibits aggression towards any person or towards other dogs, creates any unnecessary disturbances, or engages in unsafe or disruptive behavior will be expelled from training without refund.

Payments Responsibility: HOA may from time to time allow training participants to “reserve” a space in class via alternate methods (i.e. email, web form, etc.). Upon confirmation to the owner by HOA on receipt of the reservation, owner acknowledges and accepts responsibility for full payment for the training session in the timeframe indicated on the announcement of the training opportunity.

Fees: Fees for training are due prior to the beginning of the training session. This includes all classes, seminars and/or private lessons.

Refunds:

Classes: Registration and payment of the training enrollment fee is a binding commitment that the owner and dog will attend the training session. No makeup sessions or refunds will be offered for missed classes. NO REFUNDS AFTER THE FIRST NIGHT OF CLASS.

Seminars: In the event that the owner must withdraw from a seminar, High Octane will attempt to fill the vacancy. In the event that a replacement is found, High Octane will refund the cost of the seminar minus a $25.00 handling fee.  In the event a replacement cannot be found, no refund will be given.

Bitches in Season: Bitches in season are allowed to train at the HOA facility in our Foundation level classes and above. BIS must be wearing pants while on HOA property and a towel/mat must be used on the start line and table.

Inclement Weather Policy: Snow or other potentially hazardous weather or emergency situations may necessitate cancellations. Clients should use their best judgment in regards to their safety and travel arrangements. Reasonable effort will be made by HOA staff to notify class members regarding any cancellation. If in doubt, please call the HOA office. Classes which are cancelled due to weather and/or emergencies will be added to the end of the session.

Guarantees: No guarantee is given on training programs. Every dog is an individual and the success of ANY training program, no matter how good the instructor or materials, is dependent on the owner/handler’s interaction, relationship, amount of practice, and level of commitment. HOA has no way to control these factors and therefore cannot guarantee any final outcome.

Setup/Tear Down: Owner understands that, as a student or instructor training with HOA, they have an obligation to help with equipment. In particular, owner must arrive at the designated time and help the instructor set up the equipment. Owner must help change jump heights during class. Owner must stay after class and help put the equipment away.

Liability Waiver

I (We) agree to abide by the rules and regulations set forth for the agility training sessions of High Octane Agility LLC. I (We) hereby release and waive High Octane Agility LLC, the owners, the officers, directors, instructors and members thereof, and owners of the premises (Michael and Kim Decher and Autumn Breeze Acres Inc.) upon which training is held, from any claim for damages which may occur to me, my attendants or my dog(s), or expenses arising out of any injury to any property caused by my dog(s), my attendants or myself.

 

I understand and acknowledge that there may be hazards relating to the classes, events and facilities, including, but not limited to the conditions of flooring, parking areas, lighting, structures, security or lack thereof, electrical appliances, fittings, agility equipment, and other physical characteristics of the site, and I assume the risk of any harm arising from the above listed exposures. Furthermore, I understand that attendance at a dog agility training class or event is not without risk to myself, members of my family, guests who might attend, or to my dog, because some of the dogs to which I will be exposed may be difficult to control even when handled with the most experienced person. I hereby waive and release all those aforementioned from any and all liability of any nature for injury or damage which I or may dog may suffer, including, specifically by without limitation, any injury or damage resulting from the action of any dog. I expressly assume the risk of such damage or injury while attending any training session or function while on the training grounds or the surrounding area. In the event that either my dog or I are injured by another dog prior to, during or following an event/class/seminar hosted by High Octane Agility LLC, I agree to hold harmless High Octane LLC, its Board of Directors, officers, instructors and property owners for any injury suffered or sustained by myself and/or my dog(s).

 

I/We also state that my/our dog(s) is/are not aggressive towards people or other dogs and that I understand I alone am responsible for the behavior of my/our dog(s), that any dog, which is out of control, creates any unnecessary disturbance or engages in unsafe or disruptive behavior, may at the discretion of High Octane be expelled from the event/training grounds with NO RUFUNDS.
